Friday asks for appeals court review in eagle case

CHEYENNE - A Northern Arapaho man who killed a bald eagle for use in his tribe's Sun Dance has asked the entire 10th U.S. Circuit Court of Appeals to review last month's decision by a court panel that he must stand trial on a misdemeanor charge.

Twenty-three-year-old Winslow Friday, of Ethete (EE'-thet-ee), filed a petition late last week asking all 12 active judges on the appeals court to review the decision by the three-judge panel.

The American Civil Liberties Union on Monday asked for permission to enter the case to argue on Friday's behalf.

Last month's appellate court ruling reversed a 2006 decision by U.S. District Judge William Downes of Wyoming to dismiss the charge against Friday. Downes said the U.S. Fish and Wildlife Service wouldn't have given Friday a permit to kill the bird even if he had applied for one.
